A Calgary construction supervisor will pay thousands of dollars in fines in connection to a 2021 incident on a worksite that left an employee with serious injuries.
Jeffrey Gross has plead guilty to one count under the Occupational Health and Safety (OHS) Act for failing to take all the necessary precautions to protect the health and safety of a worker. Four other charges under OHS legislation were withdrawn.
He was sentenced Tuesday in a Calgary court room and will pay $30,000 in fines, which includes a 20 per cent victim fine surcharge.
Gross and the Crown both have 30 days to appeal the conviction or penalties.
The charges stem from an incident at a construction site in Calgary on Dec. 10, 2021. A worker was working on a roof and removed plywood that covered an opening. The worker slipped and fell 4.5 metres through the opening and was seriously hurt.
According to the province, Graham Construction and Engineering Inc. and Graham Construction and Engineering LP (two entities) are charged as employer and prime contractor with seven counts under OHS laws also in connection to the same incident. The companies’ trial kicks off in a Calgary court room on Oct. 21.
