Calgary Transit peace officer charged in alleged on-duty assault

A Calgary Transit peace officer has been charged by police for an alleged assault while he was on duty earlier this year.

Calgary Police Services (CPS) says around 1 p.m. on Tuesday, Feb. 13, transit peace officers were dispatched to the Marlborough CTrain Station for a medical event.

While dealing with this call, police say an unrelated man initiated a verbal fight with the officers on scene, causing a disturbance.

Investigators say the man was told to leave the transit station, but refused to do so, resulting in him being arrested.

According to police, the arrest became physical, and the man was hit several times while being restrained.

The man was taken by peace officers to hospital as a precaution and later received a ticket for not leaving Calgary Transit property, and a one-year ban under the Trespass to Premises Act.

After an investigation by CPS into the actions of the officers involved, and a consultation with Alberta Crown Prosecution Services, Calgary Transit Peace Officer Joshua Tyler Franks has been charged with one count of assault.

The 36-year-old is set to appear in court on Tuesday, Sept. 24.
