Cafe in NW Calgary suing city over water main break

A proposed class-action lawsuit has been filed against the City of Calgary over the summer’s massive water main break.

Angel’s Cafe, located near the June 5 rupture along 16 Avenue NW, alleges the city knew the pipe was made of lower-grade materials and should have moved to prevent the failure.

The suit says the cafe was forced to remain closed on weekends when it usually generates big revenue, including as Father’s Day and Canada Day.

Clint Docken, the lawyer for the cafe, says he’s heard from other area businesses that suffered similar losses.

Utility provider Enmax Corp. is also named in the suit. Allegations in the suit have not been proven, and neither the city nor Enmax were immediately available for comment.

The lawsuit has yet to be certified as a class-action by the court.

Calgary remains under Stage 2 outdoor water restrictions, and the repaired pipe is now running at 70 per cent capacity.
